THE WRITING REVOLUTION, THE HOCHMAN METHOD, ADVANCING THINKING THROUGH WRITING, and TWR REVOLUTIONARY trademarks, associated logos, product and service names, designs, and slogans are trademarks of TWR. You must not use such marks without the prior written permission of TWR. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

Prohibited Uses

You may use the website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the website:

• In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

Monitoring, Enforcement & Termination

We have the right to:

• Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
• Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the website or the public, or could create liability for TWR.

Account Registration and Security

You may be required to register for an account to access certain features of this Site. By registering, you agree to provide accurate, current, and complete information and to maintain and promptly update your account information as necessary.

You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities under your account. You agree not to disclose your password to any third party and notify us immediately of any unauthorized use of your account or any other security breach.

We reserve the right, in our sole discretion, to suspend, deactivate, or terminate your account and/or to remove, reclaim, or change a username you select if we determine that it is inappropriate, obscene, misleading, or otherwise objectionable.

Payments and Registration

Registration in training may require payment. All fees are listed in USD and are due upon completion of a registration form. You agree to provide accurate and current billing information.

When you purchase a right to use or access a Service, the Service will be available for digital delivery, the later of, shortly after payment has been received and processed, or if applicable, after an advertised start date. The Writing Revolution uses third-party services providers to manage credit card processing, and your credit card information is transmitted directly to the third-party service. This third-party processing service is not permitted to store, retain, or use your billing information except as necessary to process your credit card information for current or future purchases. Your full credit card number is never transmitted to or viewed by anyone at The Writing Revolution (however, we are given and may print a portion of your credit card information on your receipt to let you know what credit card you used to make a purchase). The company name on your receipt will appear as “The Writing Revolution, Inc..” You will receive an email receipt following each credit card charge. By purchasing a Service, you acknowledge and agree that the Service may only be accessed through the web-based environment and any other platforms, applications or sites that The Writing Revolution, Inc., specifically authorizes. If The Writing Revolution, Inc., provides or offers a Service without charge, The Writing Revolution, Inc., has the right at any time to start charging a fee for the Service, provided we notify you of such fee before you incur it. If a fee applies, your use and access to the Services is subject to your full and timely payment of such fee.

Transfer of Membership or Training Access

Memberships or training access may not be transferred to another person or account, nor may access be shared with anyone other than the individual account holder.

Live Virtual Training Registration

If the membership purchased includes a live virtual training, participants agree to register for a training offering that begins within 30 days of the membership purchase date. If a participant fails to select a training within 30 days, they will automatically be registered in the next available training.

Membership Cancellation Policy

Memberships cannot be canceled once activated. If no element of the membership has been activated by the assigned individual, the school/district/state account administrator reserves the right to request a transfer of membership to another assigned individual.

a. Training Cancellation by User

• If the training schedule you initially selected can no longer be accommodated, you will have up to 14 days prior to the start date to choose an alternative training schedule.

  Please note: Once any portion of the training has been activated, cancellation will no longer be possible. However, you may still select a different training option if needed.

b. Training Cancellation by Organization

• We reserve the right to cancel any training due to insufficient registration, instructor unavailability, or other unforeseen circumstances.
• In such cases, you will be offered alternative training options.

By registering, participants agree to these terms and are ensured flexibility while maintaining clarity and fairness in the training registration process. Please ensure you are fully aware of your commitment before proceeding with your registration.

Limitations of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL TWR, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

4. Remove or disable content or files from the Site that are excessive in size or that otherwise strain our technical infrastructure, with or without prior notice;
5. Otherwise, manage the Site in a manner intended to protect our rights, maintain system integrity, and ensure the Site operates effectively for all users.

Feedback

If you send or transmit any communications or materials to TWR by mail, email, telephone, or otherwise, suggesting or recommending changes to the website, including without limitation, new features or functionality relating thereto, or any comments, questions, suggestions, or the like (“Feedback”), TWR is free to use such Feedback irrespective of any other obligation or limitation between the parties governing such Feedback. Applicability

These Additional Terms for Services for the generative artificial intelligence services made available through the MyTWR Hub (“MyTWR Hub Terms”) apply to your access or use of the [JUDY AI Activity Generator and Coach] or [TWR Revolutionizer Curriculum Analyzer and Modifier] (together, the “GenAI Tools”) within our website. Unless otherwise defined in these MyTWR Hub Terms, capitalized terms have the meanings given to them in the current version of our Terms of Use(or other applicable governing terms).

These MyTWR Hub Terms may be further supplemented by product specific terms, which together with the Terms of Use, Privacy Policy and any other terms or conditions set by TWR will be referred to hereinafter as the “Agreement.”

If there is a conflict between these MyTWR Hub Terms and any other terms of the Agreement, the order of precedence shall be, unless modified by separate agreement between you and us, (1) product specific terms, (2) these MyTWR Hub Terms, and (3) the Terms of Use, including the Privacy Policy.

Definitions

For purposes of these MyTWR Hub Terms:

• “User Content” means user content or documents uploaded by a user to the GenAI Tools.
• “User Prompt” means an input by a user in the form of a query, statement, or instruction, intended to guide the GenAI Tools in generating an Output or completing a task.
• “Output” means any text, information, or other content that the GenAI Tools generate in response to a User Prompt and/or based on User Content and return to a user.

Ownership of Resources and Templates

All materials, including but not limited to customizable templates, downloadable activities, and digital content on MyTWR Hub, are the exclusive property of The Writing Revolution. You are granted a limited license to use these resources for instructional purposes only. Redistribution or derivative commercial use is strictly prohibited.

Provision of User Prompts and User Content

You may provide a User Prompt and User Content to the Services for the purpose of receiving an Output from the GenAI Tools. By so doing, you (a) represent and warrant that any User Prompt or User Content provided to the GenAI Tools complies in full with the Terms of Service, including without limitation with respect to the sections titled “Prohibited Uses” and “Content Standards”; and (b) you agree and acknowledge that the provided User Prompts and User Content will be subject to the full Terms of Service including without limitation the sections titled “Monitoring Enforcement & Termination” and “Information About You and Your Visits to the website.”

Proper Use of Outputs

Subject to the use restrictions set forth in the Agreement and to the extent permitted by applicable law, as between you and us, TWR owns all Output generated from your use of the GenAI Tools, provided that (a) such ownership does not constitute a transfer of any rights you possess to any User Prompts or User Content provided by you in the course of creating or modifying the Output, and (b) you are granted a non-exclusive, worldwide, royalty-free license to use the Output for purposes contemplated and authorized under the Agreement. This license does not transfer ownership of our or our third party licensors’ intellectual property in or to the Output to you and your use of such Out is subject to all restrictions and limitations set forth in the Agreement.

You acknowledge that, due to the nature of the GenAI Tools, other users may receive Output that is similar or identical to Output generated for you, provided that such Outputs will not be created with the use of your User Prompts or User Content.

You may not use our Output for any purpose except as contemplated and authorized under the Agreement. In particular, commercial use, resale, public distribution, or representation of any Output or related resource as your own is strictly prohibited. Under no circumstances may you use the Output to train or develop any artificial intelligence or machine learning algorithms or software, or create any derivative works, compilations or collective works or in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of TWR or any third party, or that violates any applicable law.

Commercial Use and Redistribution Prohibited

You may not use any materials from MyTWR Hub—including but not limited to Outputs, downloadable activities, content example resources, or customizable templates—for any commercial purpose.

This includes, without limitation:

• Selling, licensing, or distributing any content created with or derived from the MyTWR Hub on third-party marketplaces, such as Teachers Pay Teachers, Teacher Resource Libraries, or similar platforms.
• Reposting any TWR resources (including AI-generated content) in modified or unmodified form for sale, commercial promotion, or distribution.
• Recreating or adapting TWR’s customizable Google Slide templates or downloadable activities and representing them as your own original work.
• Rebranding or representing any Output, customizable template, or downloadable resource from MyTWR Hub as your own original work.

Disclaimer regarding the output of Generative AI models

Outputs are not intended for use as professional advice on any subject. GenAI Tools should not be used to seek or provide legal, medical, financial, or other kinds of professional advice.

You acknowledge that the outputs of the GenAI Tools are provided “as is” without warranty of any kind. You acknowledge that the content generated by our GenAI Tools may incorporate elements from publicly available data, like patent data, datasets, or other sources. While we take measures to ensure that our GenAI Tools comply with applicable copyright laws and respect intellectual property rights, there is a possibility that the generated content may inadvertently resemble or replicate copyrighted material. We strive to provide copyright protection mechanisms within our GenAI Tools to mitigate the risk of copyright infringements. TWR makes no warranty that the Outputs will be correct or accurate, and we recommend reviewing Outputs before using them. You assume the entire risk arising out of the use of the GenAI Tools and Outputs thereof. To the extent that we may not disclaim any warranty as a matter of applicable law, the scope and duration of such warranty will be limited to the minimum permitted under such law.

Third Party Technology Partners

TWR may use technology provided by third party service providers to provide some functionality for GenAI Tools. While we endeavor to select reputable providers, these third-party services operate independently, and we do not have control over their internal policies or practices.

You acknowledge that any User Prompt or User Content that you provide, including any personal data you choose to include, may be shared with such third party service providers to enable functionality within GenAI Tools. By using GenAI Tools, you direct and consent to personal data you include in a User Prompt or User Content being transferred to these third parties, including, but not limited to, NIIT (USA), Inc., and you agree that your use is subject to the terms of those third parties. We may also share your data with select third party service providers we engage to enable functionality within GenAI Tools and they may also use your data to improve their services. This may include any personal data you choose to include within such Input and you acknowledge that our Privacy Policy applies to the handling of such personal data.

You agree to hold harmless and indemnify TWR, our affiliates and subsidiaries, officers, directors, agents, and employees from and against any third-party claim arising from or in any way related to (i) your breach of this Agreement, (ii) your use of the GenAI Tools, or (iii) your violation of applicable laws, rules or regulations in connection with the GenAI Tools.

Abuse Detection & Download Limitations

TWR reserves the right to monitor account activity for abuse of any kind, including without limitation patterns of automated scraping, mass downloading, or excessive content requests. If an account is found to be engaging in such behavior, TWR may at its sole discretion and without warning temporarily or permanently suspend access to MyTWR Hub and associated resources. This includes, but is not limited to, the use of browser automation tools, bots, or scripts to extract content or bypass normal user workflows.
